1. Who we are
Picky is operated by Nikita Kyrushko, an individual based in the United Kingdom
trading as "Picky" ("Picky", "we", "us"). Picky is run by an
individual, not a registered company. You can contact us at hello.picky.ai@gmail.com.
These terms govern your use of the Picky mobile application, the get-picky.com
website, and the services available through them (together, the "Service").
By creating an account or using the Service you agree to these terms. If you do
not agree, do not use the Service.
Our Privacy Policy (available at get-picky.com/privacy) explains how we handle your
personal data and forms part of your agreement with us.
2. What Picky is — and what it is not
Picky scans restaurant menus and uses artificial intelligence to flag dishes as
SAFE, CHECK or AVOID against the food restrictions you tell us about.
Picky is a decision-support tool, not a guarantee. You acknowledge and agree
that:
Verdicts are generated by AI from a photograph or text of a menu. Menus are
incomplete, kitchens change recipes, and AI makes mistakes. A SAFE verdict
is an informed estimate, not a promise that a dish is safe for you.
Picky does not provide medical, dietetic or nutritional advice, and is not a
substitute for advice from a doctor, dietitian or allergist.
If you have a food allergy or intolerance that could cause a serious
reaction, you must not rely on Picky. Always confirm ingredients and
preparation directly with the restaurant before ordering.
Community signals (where shown) are aggregated reports from other users and
reflect their experiences, not verified facts about a restaurant.
3. Eligibility and your account
You must be at least 13 years old to use Picky. We ask for your date of
birth at onboarding and block accounts for anyone under 13.
You must give accurate information (including your food restrictions — the
quality of your verdicts depends on it) and keep your login credentials
secure. You are responsible for activity on your account.
One account per person. Accounts are personal and may not be shared or sold.
4. Free tier and subscriptions
Free tier: 2 menu scans, plus any bonus scans earned through referrals.
Free accounts see dish names and SAFE/CHECK/AVOID verdicts only.
Picky Pro: £6.99 per month or £69.99 per year (prices include VAT where
applicable). Pro unlocks unlimited scans, dish reasons, ingredient
breakdowns, saved restaurants, shareable cards and group dining.
Subscriptions purchased in the iOS app are billed by Apple through your App
Store account; subscriptions purchased in the Android app are billed by
Google Play. They are additionally governed by the applicable store terms.
Subscriptions renew automatically until cancelled. You can cancel at any time
through your App Store or Google Play subscription settings. Cancellation
takes effect at the end of the paid period unless the store tells you
otherwise.
Cooling-off: you have a statutory 14-day right to cancel a distance
purchase. Because Picky Pro is a digital service supplied immediately, at
checkout you consent to immediate supply and acknowledge that once you begin
using Pro features your right to a full cooling-off refund may be lost, save
for a pro-rated refund for service not yet supplied where the law requires
it. Nothing in this section affects your statutory rights under the Consumer
Rights Act 2015.
We may change prices with at least 30 days' notice; changes apply from your
next renewal. If you do not agree, cancel before the renewal.
5. Referrals
Referral links grant bonus scans (currently +5 each) to both the referrer and
the new user when a referral is validly applied at signup. Referral rewards
have no cash value, may be adjusted or withdrawn prospectively at any time, and
may be revoked where we reasonably believe codes are being farmed, shared
publicly at scale, or otherwise abused.
6. Acceptable use
You agree not to:
upload content that is unlawful, infringing, or that you do not have the
right to share (menu photos of publicly displayed menus are fine);
attempt to probe, overload, scrape, reverse engineer or interfere with the
Service or its AI systems, or use the Service to build a competing dataset;
misuse group dining sessions or referral codes;
use the Service other than for its intended personal, non-commercial purpose.
We may suspend or terminate accounts that breach these terms, with notice where
practicable.
7. Your content and our licence
You keep ownership of the content you upload (menu photos, meal ratings,
notes). You grant us a non-exclusive, worldwide, royalty-free licence to host,
process and display that content solely to operate and improve the Service —
including sending menu images to our AI provider to generate verdicts and
producing aggregated, non-identifying community statistics as described in the
Privacy Policy. This licence ends when you delete the content or your account,
except for aggregated data that no longer identifies you and copies held in
routine backups for a limited period.
8. Our intellectual property
The Service — including the Picky name, logo, app, website, design and
generated verdict presentation — is owned by us or our licensors. We grant you
a personal, non-transferable, revocable licence to use the app and website for
their intended purpose. No other rights are granted.
9. Availability and changes
The Service is provided on an "as available" basis. We may modify features, run
maintenance, or withdraw the Service. If we permanently withdraw a paid feature
you have prepaid for, we will refund the unused portion. We are not liable for
outages caused by third-party providers (hosting, AI, payments) or events
outside our reasonable control.
10. Liability
Nothing in these terms excludes or limits our liability for death or personal
injury caused by our negligence, fraud or fraudulent misrepresentation, or any
other liability that cannot be excluded under the law of England and Wales.
Subject to that:
We supply the Service with reasonable care and skill, but we do not
warrant that any verdict is accurate or that any dish is safe for you. You
are responsible for your own food choices and for verifying ingredients with
the restaurant, particularly where a mistake could harm your health.
We are not liable for losses that were not foreseeable when you agreed to
these terms, losses not caused by our breach, or business losses (Picky is
for consumers).
Our total liability to you in respect of the Service is limited to the
greater of £100 and the amounts you paid us in the 12 months before the
event giving rise to the claim.
If you are a consumer, these terms do not affect your statutory rights.
11. Termination
You can stop using Picky and delete your account at any time (Settings, or by
contacting us — deletion is described in the Privacy Policy). We may suspend or
terminate your account for material breach of these terms; where the breach is
remediable we will normally give you notice and a chance to fix it first. On
termination your licence to use the Service ends; sections which by their
nature should survive (2, 7, 8, 10, 13) survive.
12. Changes to these terms
We may update these terms from time to time. For material changes we will give
at least 30 days' notice in the app or by email. Continued use after the
effective date constitutes acceptance; if you do not agree, stop using the
Service and, if you have a subscription, cancel it before renewal.
13. General
These terms are governed by the law of England and Wales, and the courts of
England and Wales have jurisdiction — though if you live in Scotland or
Northern Ireland you may also bring proceedings there, and consumers retain
any mandatory protections of their country of residence.
If any provision is found unenforceable, the rest remain in force. Our
failure to enforce a right is not a waiver of it.
You may not transfer your rights under these terms; we may transfer ours to
someone who takes over running Picky (for example a company formed to
operate the Service), with notice, provided your rights are not reduced.
If you use Picky on an Apple device: Apple is not a party to these terms,
has no obligation to provide support or maintenance, and is not responsible
for any claims relating to the app; Apple is a third-party beneficiary of
this section with the right to enforce it.
